1. WHAT INFORMATION DO WE COLLECT?  

User Provided Information

In short:  We collect information when you create an account, place an order or email with us about the products that we offer on the Site.

While accessing the Site, you may provide personal information including, name, address, zip code, email address, telephone numbers, credit card numbers, birth date and answers to security questions.  Once you provide us with this personal information, we use this information for product fulfillment, account administration, marketing and to provide information about the products offered by the Company.  Thereafter, you consent to the Company sending you email messages and other electronic communications in connection with your orders and product inquiries (including, but not limited to, marketing emails). Since the Company endeavors to send email messages and other electronic communications only to individuals desiring to receive them, you can notify us at apisarcik@aabeautysupplies.com that you no longer wish to receive these communications.

No purpose in this policy will require us to keep your personal information for longer than the period of time in which users are doing business with us.  

When we no longer have an appropriate basis, given the specific use, to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

In Short:  We do not knowingly collect data from or market to children under 13 years of age.  

We do not knowingly solicit data from or market to children under 13 years of age. By using the Site, you represent that you are at least 13 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Site. If we learn, from a legal guardian or otherwise, that personal information from users less than 13 years of age has been collected, we will take reasonable measures to promptly delete such data from our records. 9. CALIFORNIA RESIDENTS

Account Information:The Company does not warrant or represent that any personal information collected on the Site will be accurate or up-to-date.  If you would at any time like to review or change any information collected from you by the Company:

11. CONTROLS FOR DO-NOT-TRACK FEATURES  

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

 

 

12. DO WE MAKE UPDATES TO THIS POLICY?  

In Short:  Yes, we will update this policy as necessary to stay compliant with relevant laws.  

We may update this privacy notice from time to time. The updated version will be indicated by an updated "Revised" date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notification of such changes or by notifying you directly. 

 

13. APPLICABLE LAW

In Short:  New York law governs this policy.

This policy shall be governed by, and construed and interpreted in accordance with, the laws of the State of New York, without regard to its principles of conflict of laws.  If there is any conflict or inconsistency between any provision of this policy and any provision of any applicable law, the latter shall control.


14. ENTIRE AGREEMENT

In Short:  This is the entire agreement on privacy.

Except as set forth in this Section, this policy contains the entire agreement, and supersedes all prior oral and written agreements, proposals and understandings, between you and the Company, with respect to collected data.  If you use the Site, such use or dealings will be subject to this policy, plus any other written agreement between you and the Company that is applicable thereto. To the extent there is any conflict or inconsistency between any provision of this policy and any provision of such other agreement, the former shall control.

In Short:  Invalid provisions of this policy can be severed and/or modified to comply with the law.

18. COMPLAINTS

Any complaint by you regarding any collected information, or otherwise relating to this Privacy Policy, must first be submitted to the Company at apisarcik@aabeautysupplies.com, and the Company must be given a reasonable opportunity of not less than 30 days to investigate and respond to your complaint.  Upon the Company’s completing such investigation and so responding, the Company and you must then attempt, in good faith, to promptly resolve any remaining aspects of your complaint.  If any aspect of your complaint remains unresolved after an additional reasonable period of time of not less than 30 days, (a) you may commence litigation against the Company in connection with the unresolved portion of your complaint only in a court located in Erie County, New York, and having subject matter jurisdiction over your complaint, and (b) you consent to any such court’s being, and waive any objection (including, but not limited to, any such objection based on inconvenience) to such court’s not being, a proper venue for your complaint.
